1The Challenge
Our client, a senior software architect at a major Silicon Valley company, had limited academic publications — a common concern for industry professionals applying under EB-1A. Their initial self-filed petition received an RFE questioning 4 of the 6 claimed extraordinary ability criteria. With the response deadline approaching, the client came to us for help.
2Our Strategy
We conducted a thorough audit of the client's career achievements, identifying evidence angles they had overlooked. We focused on original contributions of major significance through 3 key patents that had been widely adopted in the industry. We obtained 5 expert opinion letters from recognized authorities and restructured the entire petition narrative around industry impact rather than traditional academic metrics. We documented the client's role as a judge for IEEE conferences and their high salary as top 5% in the field.
3The Outcome
The RFE response was approved without further questions. The entire process from our engagement to approval took 6 months. The client successfully obtained their EB-1A green card and has since been promoted to Principal Engineer.
